LOS ANGELES — Walker & Dunlop has arranged $34.8 million in construction financing for 4301 Vermont, an affordable housing development in Los Angeles. Chris Montes of Walker & Dunlop secured the loan on behalf of the client, SoLa, and identified the lender as ACORE Capital. The five-story multifamily complex will offer 188 affordable residences at 4301 Vermont Ave. Approximately 80 percent of the units will be designated for low-income residents, while 20 percent will be reserved for moderate-income residents. The project will feature prefabricated modular units supplied by Model Z, a subsidiary of SoLa Impact.
PITTSBURGH — KeyBank has provided $41.4 million in financing for First & Market, an adaptive reuse project that will convert a former office building in downtown Pittsburgh into a 93-unit affordable seniors housing complex. The financing consists of a $27 million construction loan and a $14.4 million permanent loan. Units will be reserved for renters age 62 and above, with the majority (83) of residences reserved for individuals earning 50 percent or less of the area median income (AMI). The other 10 units will be earmarked for households earning 20 percent or less of AMI. Residents will have access to support services in technology education, healthcare education and coordination, financial literacy and mental and behavioral health. Seaver Rickert and Leslie Meyers of KeyBank originated the financing on behalf of the developer, Beacon Communities. Completion is slated for the third quarter of 2026.
NEW YORK CITY — Newmark has arranged a $275 million loan for the refinancing of 63-67 Wall Street, an apartment complex in Lower Manhattan that comprises 816 units across two buildings. The buildings were originally constructed for office use: 67 Wall Street was built in 1921 as the headquarters for the Munson Shipping Co., and 63 Wall Street was built in 1928 as the headquarters for Brown Brothers Harriman & Co. The buildings were converted into apartments in 2006 and 2004, respectively. Units come in studio, one- and two-bedroom floor plans, and amenities include a fitness center, rooftop terrace with a lounge and grilling stations, game room, golf simulator, library, children’s playroom and a business center. Jordan Roeschlaub, Nick Scribani and Chris Kramer of Newmark arranged the financing on behalf of the owner, a partnership between Boston-based real estate private equity firm Rockpoint and investment and management firm Brooksville Co. Apollo Global Management provided the loan. The partnership acquired the buildings in 2016 and has since invested in capital improvements.

Last fall, Everett, Washington, became the first city in the Western United States to pass a ballot measure recognizing the rights of a river’s watershed — that of the Snohomish River, which curves north and east around the city before emptying into Puget Sound. The municipal law protects the river’s “rights to exist, regenerate and flourish” and is designed to be a tool for residents seeking to prevent or repair harm to the river’s watershed.
“These ecosystems have inherent rights. We are just acknowledging them by giving them legal standing in a court of law,” said Abi Ludwig, co-founder of Standing for Washington, a political action committee that supported the initiative.
The law is the latest attempt in two decades of concerted efforts at the tribal, city and international level to codify a different legal relationship between people and their environment — one in which water, wildlife and land are not just resources to be used and abused by humans. In the U.S., several similar “rights of nature” laws have failed legal challenges, and Everett’s law could meet the same fate: In late January, a group of local developers and business owners filed suit against it. But according to Ludwig, the campaign learned from past experience, and the new ordinance is designed to survive. “Even though it’s this emergent strategy,” she added, “I think people are ready to embrace something new, and to try something new.”
In our current legal system, in order to sue over harm to a river or a species, a plaintiff must prove that they have “standing” — that they’ve been personally injured by the decline of that river or species. Rights of nature laws eliminate this requirement by giving legal standing to nonhuman entities. The strategy is relatively new, but the concept of reciprocity between ecosystems and human beings is much older and found in Indigenous knowledge, said Britt Gondolfi, rights of nature project coordinator with the nonprofit network Bioneers and a descendant of the Houma Nation.
“I think people are ready to embrace something new, and to try something new.”
In the U.S., tribal nations including the Yurok Tribe and White Earth Nation have used their sovereignty to adopt resolutions or amend their constitutions to enact rights of nature laws. In 2021, two town councils in Colorado passed non-binding resolutions recognizing the rights of local rivers. Other initiatives have met with more pushback; a ballot measure passed in Toledo, Ohio, that recognized the legal rights of Lake Erie was struck down in 2020 by a federal court, and in 2024, the Utah Legislature preemptively banned similar laws after author Terry Tempest Williams made a public case for the legal personhood of the Great Salt Lake.
In Everett, organizers deliberately restricted the law’s reach to city limits, since the potential for conflicts of jurisdiction doomed Toledo’s attempt to protect Lake Erie. The Snohomish River has long suffered from industrial pollution and agricultural runoff, and Everett residents’ interest in restoring the watershed helped the measure pass with 57% of the vote.
The Tulalip Tribes, whose reservation is just north of Everett, did not endorse the initiative, but Tribal Chairwoman Teri Gobin said in a statement that the tribe looks forward to seeing it translated into action: “We see value in using all tools available in the pursuit of sustainability and co-existence for the people, plants, animals, lands, and waters of our world.”
Under the new law, any Everett resident can bring a case, and any money from successful lawsuits will fund the city’s watershed restoration efforts. “We now think of it as a community stewardship model,” Ludwig said. Despite the opposition, “we have to try,” Gondolfi said. “We have to try every legal argument available to us for the preservation of what little natural world is left, in comparison to what we’ve destroyed.”

A doctor the state suspended from practicing medicine for nearly a decade has again had his license pulled for not complying with requirements after his license was reinstated last year.
State regulators accused Dr. Frank Li of failing to properly monitor use of powerful opiates at Seattle Pain Centers, rescinding his license to practice as a physician in 2016. Li later agreed to pay $2.85 million to the state and federal governments for billing Medicaid and Medicare for urine tests patients allegedly did not need, according to a settlement agreement.
Last year, Li requested that his license be reinstated by the Washington Medical Commission. The commission modified a 2018 order and reinstated Li’s license under several stipulations in June.
However, the commission again revoked Li’s license in February due to his failure to complete a competency assessment and make a peer group presentation after his license was reinstated, as the commission required. The commission stated Li failed to appear at a noncompliance hearing in February.
Li did not immediately respond to a request for comment.
The medical commission did not answer a question about why it reinstated Li’s license, stating it was under the terms of the 2018 agreement and that Li cannot now practice medicine in Washington.
Li, who is board certified in anesthesiology and pain medicine, was the sole owner of the eight now-shuttered clinic locations of the Seattle Pain Centers, where he allegedly improperly oversaw opioid-prescribing practices. Concerns over the urine tests led state officials to examine the opioid-prescribing practices at Seattle Pain Centers and deaths of more than a dozen patients.
In a 2018 order, Li agreed to complete physician and prescribing courses and write a paper on prescribing medications, which he did in April 2024, according to commission records. Under the reinstatement, Li was subject to a 10-year probation period and could not practice in pain management or operate a pain management center.
He was also restricted from employing or overseeing any other medical providers. He could prescribe oral pain medication for acute pain management and provide up to a seven-day supply of such oral pain medication with no refills.
While Li did not admit to wrongdoing in 2018, that agreement lists 16 patients in which acute drug intoxication was a cause or contributor in their deaths. It says the patients’ medical records “reveal a pattern of substandard medical care.” One state health official described Li’s patient care as “classic pill mill behavior.”
Seattle Pain Centers’ patients were given opiates inappropriately, with little supervision, in amounts that may have sent the powerful medications onto the street to be sold, officials said.
After state officials alleged Li committed billing fraud and possibly contributed to patient deaths, all his clinics were closed and thousands of patients were left scrambling for care.
Oregon Secretary of State records indicate Li became the manager of Immersive Therapies LLC last year, a corporation whose intended purpose, according to the records, is “creating supportive spaces and infrastructure for psychedelic therapies.”
Willamette Week reported last year that the Oregon Health Authority granted Li permission to operate a psilocybin service center in November 2023. Immersive Therapies opened in January 2024.
Li defended his opioid prescriptions to Willamette Week and said many of his patients came with serious drug dependencies.
Li was also licensed in California in 1999, but his license was revoked in 2018 due to the Washington practice allegations.

6:23 p.m. - NWS issues special weather statement for areas in Clallam County, WA
The National Weather Service issued a special weather statement for Port Angeles, Neah Bay and Clallam Bay, warning residents to expect 40 mph wind gusts and nickel-sized hail until 6:45 p.m.
5:21 p.m. - NWS issues special weather statement for areas in Grays Harbor County, WA
The National Weather Service issued a special weather statement for Neilton, Humptulips, and Amanda Park, warning residents to expect 40 mph wind gusts and pea-sized hail until 5:45 p.m.
5:20 p.m. - Grays Harbor PUD reports 8,400 customers without power in Ocean Shores, WA
According to Gray's Harbor PUD, the power is out for 8,400 customers in Ocean Shores and Oyehut. PUD says the outage is storm-related, but the exact cause has not been identified.
There is no estimated time of restoration. Customers are encouraged to check GHPUD's website for updates.

Seattle-Tacoma International Airport announced via social media that its teams are prepared to respond as needed to the upcoming severe-weather event on Wednesday.
3:12 p.m. - NWS issues severe thunderstorm watch
The National Weather Service issued a severe thunderstorm watch for parts of Oregon and Washington until 9:00 p.m.
2:16 p.m. - Lightning reported in King County, WA
The National Weather Service reports that lightning strikes have already been reported in south King County.
1:06 p.m. - Seattle Public Schools cancels all after-school activities
All after-school activities have been canceled for Seattle Public Schools (SPS), as the region braces for a rare threat of strong to severe thunderstorms Wednesday afternoon and evening.
Seattle Public Schools made the announcement to families and staff via email Wednesday afternoon.
"Due to the forecasted hazardous weather conditions, we are canceling all events scheduled for this evening," said the SPS Office of Public Affairs. "To prioritize the safety of our students and staff, all school buildings will be closed after 5 p.m."

The Brief
EVERETT, Wash. - An Everett man who was previously granted clemency by Governor Jay Inslee in 2019 was recently arrested on multiple gun and drug charges.
What we know:
Percy Levy, 54, was taken into custody on Thursday, March 13, following a 16-month investigation by the Snohomish Regional Drug Task Force.
Upon a search of Levy's home, detectives say they discovered and recovered 2,818 grams of powder cocaine, 14.7 grams of rock cocaine, and 556 grams of fentanyl. They also seized packaging material, a digital scale and a handgun, according to the Snohomish County Sheriff's Office.
"The amount of fentanyl in this case is staggering," said Court Commissioner Jennifer Millett today at Levy's hearing on Monday.
Levy was booked into jail for unlawful possession of a firearm, possession of a stolen firearm, and multiple counts of possession of a controlled substance with intent to deliver.
His bail was set and maintained at $1.5 million. He is now facing 10 separate charges.
The backstory:
Back in 2019, Levy was granted executive clemency by former Washington Governor Jay Inslee and released from prison after spending 17 years behind bars.
Levy also worked as a Community Outreach Specialist for the Washington Defender Association.
