PALM BAY, Fla. – The attorney for Palm Bay Councilman Chandler Langevin is threatening legal action after a measure to strip away some of Langevin’s power was added to the city council agenda.

On Thursday, the council will vote on a resolution to censure Langevin for conduct unbecoming of an elected member and for improperly using city letterhead.

The vote is scheduled to happen two weeks after the council voted 4-1 to ask Gov. Ron DeSantis to suspend Langevin over social media posts disparaging Indian immigrants.

According to the resolution, the censure would also prevent Langevin from placing an item on the agenda, he would not be permitted to provide council reports, and he could not serve on any boards or committees.

Anthony Sabatini, who represents Langevin, said the discipline would be a violation of First Amendment rights.

“The government cannot punish and limit your rights just purely based on your viewpoint,” Sabatini said. “You can pass a censure motion, that’s fine, but you can’t limit his ability to speak based on his opinion.”

Sabatini said he’s considering a lawsuit against the city if the council moves forward with disciplinary action.

“To punish him unlawfully, you get a result of a lawsuit, and they’re going to pay his attorney fees,” Sabatini said. “Under the statute, when he wins, they’re going to have to pay his attorney fees for violating his First Amendment rights to free speech.”

Langevin also responded to the censure resolution in a post on X:

“This is clearly a violation of the law and slap in the face to the voters who elected me to carry out an agenda to reverse the decline in Palm Bay,” the post stated.

“If the council is dumb enough to vote for this there will be immediate law suits against the city.”

PALM BAY, Fla. — During Thursday night’s meeting, Palm Bay city commissioners voted to censure Commissioner Chandler Langevin, two weeks after they drafted a letter to Gov. Ron DeSantis, asking him to remove him from his position due to derogatory comments he made on social media about Indian Americans.

During the Oct. 2, city council meeting, Langevin shared that the board can grow through discomfort and that they will have uncomfortable meetings moving forward, which the resolution says could make meetings less efficient or productive as a form of retribution.

It also addresses a letter Langevin sent on official Palm Bay letterhead to a Florida congressman, asking for the pardoning of a man who pleaded guilty to conspiring to violate the federal anti-riot act and a rally he hosted that cost the city $25,000.

However, the biggest issue came from his own social media posts about Indian Americans. Some of his comments on X, previously known as Twitter, include: “Deport every Indian immediately.” And “Indians are destroying the South.”

But Langevin feels the effort is a witch hunt.

“I not only have a constitutional right, but I personally believe that I have a duty and an obligation to engage other elected officials, to have dialogue with my constituents and to drive policy in a matter that I deem best," Langevin shared.

Commissioners and Mayor Rob Medina, however, felt his actions should be designated as serious misconduct.

“I think if we represent the population at large, there’s some issues then we need to tailor our speech," Medina said. "We represent everyone, right so it is conduct unbecoming.”

With a vote of 3-2, the council moved to censure Langevin, meaning Langevin now has to receive a consensus of a majority approval from the city council to place an item on the agenda. Both Langevin and councilman Richard "Mike" Hammer both voted against the censure.

Langevin is not allowed to speak during committee and council reports, and he would also be removed from current or future City of Palm Bay boards or committees.

In his Facebook post after the meeting, Hammer stated that while he did not agree with the things Langevin said about Indian Americans, he did not agree with the restirctions placed on him.

Langevin’s attorney called the censure unconstitutional.

“The U.S. Constitution does not allow any member of the commission to be punished and have their First Amendment rights taken away purely because they express a viewpoint that some don’t like. And that’s just unlawful," explained Langevin's attorney Anthony Sabatini.

The Indian American Chamber of Commerce Orlando President Jan Gautam sent Spectrum News 13 a statement on the matter saying:

"The Indian American community received an apology from Councilman Chandler of Palm Bay earlier last week. After meeting with several community leaders, he came to understand the tremendous value the Indian American community brings to this country — especially through business ownership, job creation, and contributions as one of the strongest economic drivers in our nation.

His apology followed a recent meeting at the Palm Bay Chamber, during which Mayor Medina and his administration requested that he step down and asked the Governor to review his position.

As I stated on behalf of the Indian American Chamber of Commerce, Indian Americans are Americans — proud contributors to this nation’s growth and success. Our community appreciates his apology and chooses to move forward with positivity, focusing on unity, understanding, and the betterment of our shared future.

We wish him well and look forward to continued collaboration in building stronger communities together."

In a 4-1 vote, the Palm Bay City Council also moved to look into hiring an outside attorney to investigate whether Langevin made any ethics violations.

The councilmembers say they do plan to implement these disciplines for Langevin, as their City Attorney cited case law that would back up their motion.

Langevin and his attorney, however, say they do plan to file suit against the City of Palm Bay on Friday morning.

PALM BAY, Fla. — Palm Bay City Council member Chandler Langevin has retained Lake County District 1 Commissioner Anthony Sabatini as counsel amid the push for a censure vote Thursday.

The Palm Bay City Council is currently set to consider censuring Langevin “for conduct unbecoming of an elected member of City Council and for improperly using the City of Palm Bay letterhead.”

Sabatini wrote a letter to members of the council, arguing that such a vote could go against Langevin’s right to free speech under the U.S. Constitution.

“It has come to my attention that members of your council are seeking to unlawfully punish Councilman Chandler Langevin for his previously expressed view regarding immigration,” Sabatini wrote in his letter. “Resolution 2025-41, which has been placed on your October 16, 2025, agenda, contains several items that are punitive and constitute adverse action. Although a city council may impose restrictions on its members’ speech during council meetings, such actions are subject to constitutional limitations, particularly under the First Amendment.”

He ended the letter by saying that if the council approved the censure vote, a lawsuit would be filed for “First Amendment Retaliation.”

Langevin was the focus of another council vote earlier this month, when members voted to ask Gov. Ron DeSantis to remove him.

Seventy-six people signed up for public comment for that meeting earlier in October on the topic of Langevin, leading to several hours of discussion.

Some of Langevin’s comments on X include: “Deport every Indian immediately.” And “Indians are destroying the South.”

Earlier in the year, he made comments about Muslims and their faith, saying in one post, “Islam is neither peaceful nor strictly a religion.”

“Do you want your legacy to be that of an elected official whose overheated words incited and justified violence against the harmless, the innocent and law-abiding citizens?” asked former Brevard County Judge Alli Majeed.

Several federal and state legislators have also weighed in and condemned Langevin’s comments.

About an hour before the meeting, Langevin did post a statement on X, saying that he was willing to talk and work with the Indian community to solve issues at a local and national level.

Just before 11 p.m., the Palm Bay City Council voted 4-1 to move forward with drafting a letter to Gov. Ron DeSantis, asking him to remove Langevin from his position on the council as they do not have the power to do it themselves.

As part of that vote, the council moved to censure Langevin and remove him from his appointments and outside boards for the City of Palm Bay. They’re also planning to send an ethics violation letter to State Sen. Debbie Mayfield (R) so she can send it to the governor.
