Ohio principal resigns after investigation into his helping former homeless student

CINCINNATI (ENQUIRER) - Robert Burnside, a beloved high school principal in the Cincinnati suburbs, resigned Friday after he came under fire from his school district for helping a student who was experiencing homelessness, according to our partners at the ...

CINCINNATI (ENQUIRER) - Robert Burnside, a beloved high school principal in the Cincinnati suburbs, resigned Friday after he came under fire from his school district for helping a student who was experiencing homelessness, according to our partners at the Cincinnati Enquirer.

His resignation comes three weeks after he was put on leave pending an investigation. Records show the district investigated Burnside for allegedly allowing a former student who was experiencing homelessness to attend classes and eat at the school cafeteria.

“Please be advised that I irrevocably resign my position with the Lakota Local School District Board of Education for personal reasons,” Burnside wrote to Superintendent Ashley Whitely. His resignation is effective Jan. 30.

“It has been truly an honor to have the opportunity to be the principal of Lakota East High School, and I will always be grateful for the opportunity that the Lakota Local School District has given me to lead in this capacity,” his letter reads.

Burnside will remain principal of Lakota East High School in title through Jan. 30 but won’t return to the school, his attorney said. The next two months of his tenure will comprise a combination of administrative leave, sick leave and unpaid leave, for credit purposes to count toward his retirement.

Lakota Local Schools did not respond to requests for comment on Friday other than to confirm that the school board accepted Burnside’s resignation during an emergency meeting Friday afternoon. The district cannot comment on personnel matters or about individual students.

Burnside was principal of Lakota East High School in Liberty Township, about 25 miles north of Cincinnati, since 2021. The district placed him on paid administrative leave Nov. 1 and launched an investigation into “a concern,” Superintendent Whitely said in a message to district families.

That concern turned out to be Burnside’s involvement in assisting a former Lakota student who was unenrolled in the district earlier this school year, The Enquirer found in records obtained through an Ohio Public Records Act request. District administrators grilled Burnside in a Nov. 7 pre-disciplinary meeting about his relationship to this student and why the student was allowed on school grounds while unenrolled.

The news garnered national attention and several of Burnside’s former students spoke up in his defense online.

“Mr. Burnside is hands down the best principal I ever had through schooling at Lakota,” one user commented on The Enquirer’s Instagram post about the story. “He was always joyful and excited to see everyone and knew everyone by name. He kept a lot of us from leaving during COVID and you can tell he has heart, passion, and care for everything he does.”

Another user commented: “Mr. Burnside is the most compassionate, understanding, and supportive school administrator I’ve ever had the pleasure of learning under. Lakota East, and the Lakota Local School District are beyond blessed to have him, and any reaction on behalf of the school to him providing and caring for a student in need that isn’t unequivocal praise would be a severe injustice to not only an excellent principal, but also to every kid in the district who looks up to the leaders in our community.”

Burnside said he is grateful for the support.

“I am grateful beyond measure for the outpouring of support that I have received and I certainly have a desire to take the lessons from this period in time and to return to become an even better leader in the future,” Burnside wrote in a statement Friday afternoon. “However, at this time, in the interest of my personal health, the well-being of my family, and to avoid creating divisiveness within the Lakota school community, I have made the decision to step down as the principal of Lakota East High School and have tendered my resignation.”

Why was the student unenrolled?

It is unclear how or why the student was unenrolled from Lakota Local Schools. But there are federal legal protections for students experiencing homelessness under the McKinney-Vento Homeless Assistance Act of 1987, which ensures that students experiencing homelessness have access to a free and appropriate public education.

More than 24,000 students experienced homelessness in Ohio in the 2022-23 school year, according to the Ohio Department of Education and Workforce.

Under this law, schools cannot unenroll students for experiencing homelessness. The law requires schools to have a local homeless education liaison on staff to serve as a contact person for students experiencing homelessness, and to automatically enroll students experiencing homelessness even if they don’t have the records – such as a permanent address – typically needed for enrollment.

Districts have to keep these kids in their home school unless the student’s parent, or the student themselves, objects. Districts also need to provide transportation for students experiencing homelessness, even if those students are staying somewhere outside of the district’s boundaries.

The Enquirer has requested information from Lakota Local Schools regarding this law, the district’s procedure for following it and if the district has a liaison for students experiencing homelessness. The school district has yet to respond as of Friday afternoon.

CINCINNATI – The Ohio Department of Transportation (ODOT) continues to make progress to outline a project to repair the southbound approach to the I-471/Daniel Carter Beard Bridge that connects downtown Cincinnati to Newport, Ky. Here are the latest updates from ODOT, Kentucky Transportation Cabinet (KYTC), and the city of Cincinnati.

More Shoring Needed on Damaged Southbound Span

Structural engineers have determined that due to the damage to load-bearing beams on the southbound approach span, additional shoring towers will be needed before demolition can begin. Four beams were significantly damaged by the fire and are no longer supporting the weight of the concrete deck of the bridge.

In a traditional demolition, crews would simply saw cut the concrete deck and remove it before removing the steel beams. In this case, demolition cannot take place until there is proper support added under the deck. Crews are expected to begin pouring footers for these new shoring towers early next week.

Northbound I-471 Lane Closure

A more detailed inspection of the concrete wall on the left side of northbound I-471 has revealed damage that will need to be repaired as well. The damaged section is about 60 feet long; however, it does not impact the structural integrity of the bridge. ODOT will be coordinating with KYTC on the repairs and when these can begin. This includes establishing a permanent lane closure by replacing the barrels with concrete barrier wall.

Project Updates

This week, we are shifting gears from daily updates to provide updates as they are warranted. As we move into construction, we anticipate providing regular updates to inform you about the progress that has been made and the work that is planned. Of course, all updates will continue to be posted to ODOT’s web page dedicated to the bridge repair at I-471 Bridge Fire.

Southbound I-471 traffic is being detoured by way of I-71 and I-75 South. Thru-traffic motorists and heavy truck (semi) drivers traveling south should use I-275 to I-71/75 to avoid delays, and all HAZMAT operators are required to follow the I-275 outerbelt.

Kentucky Traffic Impacts

A single-lane closure is in effect on I-471 North beginning at the 3.6-mile marker near Memorial Parkway and continuing across the Daniel Carter Beard Bridge.

BATAVIA TOWNSHIP, Ohio —

One person is dead and four others were injured after a crash on State Route 132 in Clermont County Wednesday.

It happened around 9 a.m. when troopers with the Ohio State Highway Patrol responded to a fatal crash involving two cars on State Route 132 near Woodbury Glen Drive.

According to OSP, a preliminary investigation revealed a 2021 Nissan Rogue, driven by John Brinker, 78, from Cincinnati, was traveling south when he traveled left of center and hit another car before veering off the road and hitting a guardrail.

Brinker was pronounced dead at the scene.

The driver that was hit was taken to Anderson Mercy Hospital with minor injuries. Three passengers inside of the vehicle hit were taken to Clermont Mercy Hospital for minor injuries.

OSP said Brinker was not wearing a seatbelt at the time of the crash. The crash remains under investigation.

Cincinnati doctor under investigation by State Medical Board for alleged sexual misconduct

Dr. David Wenzke built his career as a gastroenterologist serving patients in Greater Cincinnati, and before that, Columbus.

Currently, he's employed by Gastro Health but has been suspended pending the outcome of an investigation being conducted by the State Medical Board of Ohio for alleged sexual misconduct allegations involving three patients.

Medical board records lay out a series of alleged events that it says could lead to Wenzke's medical license being revoked or suspended.

According to the documents, the board claims in 2012, Wenzke performed a colonoscopy on a female patient and allegedly "touched and squeezed her breasts as she was being sedated" and allegedly touched her inappropriately after the procedure.

In 2020, as a patient was "waking up from sedation," the Medical Board claims Wenzke "lifted her gown away from her body to look at her breasts."

The documents do not state where Wenzke was employed at the time of either allegation.

Another allegation involves a co-worker who was also a patient.

In March of last year, while she was "intoxicated and almost asleep," documents state Wenzke allegedly kissed her.

Due to patient confidentiality, it's not clear who brought these allegations.

Ohio Medical Board records also note that in 2011, staff at the Ohio Gastroenterology Group reported Wenzke had touched the "genitals of a female patient without gloves" and six years later "performed a gown change for a sedated teenage patient" by himself. He was terminated from the Columbus-based practice, according to medical board records.

Wenzke's attorney, Jason Gerken, said in a written statement, "Dr. Wenzke is aware of the allegations pending before the State Medical Board. He vigorously denies the allegations, and he looks forward to presenting his case to the Board."

Wenzke most recently worked at Gastro Health in Blue Ash. While most of the allegations stem from Wenzke's previous employments, a spokesperson for Gastro Health said in a written statement, "Gastro Health was made aware that Dr. David Wenzke is being investigated by the State Medical Board of Ohio. Upon notification of the investigation, Dr. Wenzke was placed on immediate suspension and is not currently involved in patient care at Gastro Health. The health and safety of our patients is always our top priority. Based on the outcome of the investigation, further action will be taken."

Gastro Health told WLWT it did its due diligence when hiring Wenzke in October 2020 and was not made aware of any of the previous allegations.

Wenzke's hearing in front of the State Medical Board has been set for June.
