WACO, Texas (KWTX) - A former Baylor University fraternity president who was placed on deferred probation in 2018 after a student accused him of raping her at a party is back in the McLennan County Jail after authorities filed a motion to adjudicate his guilt and revoke his probation.
In a motion filed earlier this month, McLennan County prosecutors allege Jacob Walter Anderson committed at least nine violations of his probation, including having sexual contact with an infant, viewing sexually oriented materials and failing to avoid contact with minor children.
Judge Thomas West of Waco’s 19th State District Court has set a Tuesday hearing to consider a motion from Anderson’s attorney, Charles Johnson, of Houston, to reduce Anderson’s current bond of $250,000. Johnson said Monday that he is prepared to defend the allegations in the state’s motion.
Anderson, 29, who had been charged with sexually assaulting a Baylor sophomore at an off-campus Phi Delta Theta fraternity party in 2016, pleaded no contest to a lesser charge of unlawful restraint and was placed on deferred probation for three years. Prosecutors agreed to dismiss four counts of sexual assault against Anderson in a plea bargain that ignited a public furor and a petition drive opposing the plea agreement signed by more than 85,000 people.
Baylor kicked Anderson out of school and suspended the fraternity in the wake of the allegations, and the victim reached undisclosed settlements with the fraternity and at least 17 fraternity members in a civil lawsuit.
In deferred probation cases, there is no final judgment of guilt if the defendant successfully completes probation. In Anderson’s case, prosecutors are asking West to find him guilty, revoke his probation and put him in prison. He faces up to 10 years in prison on the third-degree felony.
Anderson, a Garland resident, was placed on deferred probation for three years in 2018 and was being supervised by the Dallas County probation department on a specialized sex offender caseload. His probation was extended by an additional three years after a number of violations, including accessing the internet to view sexually explicit materials and, later, to stream music.
His internet privileges were revoked, and in February 2021, Anderson admitted “sexually deviant fantasies involving minors,” which resulted in amended orders for him to have no contact with minors and child safety zone restrictions were imposed.
That same month, Anderson’s sex offender treatment provider recommended his probation term be extended for a minimum of three years because “Mr. Anderson’s almost indiscriminate arousal to behaviors involving power/control, degradation and violence, reflect a person who would be a significant threat to the community, especially those with whom he has a relationship, if left unmonitored,” according to court records.
On Nov. 4, Anderson’s probation officer noted that he disclosed to his therapist that he “sexualized” a baby boy and touched him improperly while changing his diaper.
“He said he kept it a secret because, in his mind, that meant he molested him,” according to probation records. “He said he did not take it any further because he was on probation and was trying to do what he thought he ‘could get away it.’”
“The defendant appears to have shown minimal improvement or changes to his sexually deviant behavior since he began sex offender treatment,” a probation department report states. “Therefore, due to the multiple technical violations, and the defendant’s continued threat to public safety, it is the recommendation of the McLennan County Community Supervision and Corrections Department that the defendant’s probation be revoked in full.”
At Anderson’s sentencing hearing in December 2018, the victim was outspoken in her disgust for the plea agreement. In an emotional victim impact statement, she described, often in graphic detail, what she said Anderson did to her.
“When I was completely unconscious, he dumped me face down in the dirt and left me there to die,” the woman said. “He had taken what he wanted, had proven his power over my body. He then walked home and went to bed without a second thought to the ravaged, half-dead woman he had left behind.”
